Fitness Certificate

The Fitness Certificate is the document that evidences the worker’s fitness to perform their duties. According to Article 110 of Law No. 102/2009, dated September 10, based on the results of medical examinations, whether periodic or occasional, the Occupational Health Physician completes and signs the respective fitness certificate, subsequently forwarding it to the employer.

If the health examination result reveals the worker’s unfitness, the occupational health physician should indicate, if justified, other functions that the worker may perform.

Whenever the function performed and/or the conditions under which it is provided prove harmful to the worker’s health, the occupational health physician must also communicate this fact to the person responsible for occupational safety, hygiene, and health services, and if the health condition justifies it, request their follow-up by the primary care physician or another doctor designated by the worker.
