The Fitness Certificate is the document that demonstrates the employee’s suitability for performing their duties. According to Article 110 of Law No. 102/2009, of September 10, based on the results of periodic or occasional medical examinations, the Occupational Physician completes and signs the respective fitness certificate and subsequently submits it to the employer.
If the health examination reveals that the employee is unfit, the occupational physician must, if justified, indicate alternative functions that the employee can perform.
Whenever the work performed and/or the conditions under which it is carried out prove harmful to the employee’s health, the occupational physician must also inform the person responsible for occupational safety, hygiene, and health services. If the employee’s health requires it, the physician should request follow-up by the employee’s primary care physician or another doctor designated by the employee.
